Under the New York State Workers’ Compensation Law, a worker assaulted by a co-worker may be covered if the altercation resulted from work place differences as opposed to personal issues.
Whether or not the source of the dispute and ultimate assault is sufficiently work connected is a question of fact for a Workers’ Compensation Law Judge to determine. A purely personal, non-work related dispute which results in an assault may not be covered.
