Section 14a of the New York State Workers’ Compensation Law provides a special protection for illegally employed minors who are injured or killed in the course of their employment.
Those unfortunate minors and/or families will receive double the amount otherwise payable under the statute. It is the employer, not the insurance carrier, who is liable for the increased compensation. These cases are relatively rare and it is clear that the legislature has attempted to punish employers who do not take proper care to certify the age of their employees at the time of hiring.
