If you have been deemed partially disabled under the New York State Workers’ Compensation Law, the maximum amount that you are eligible to receive is 50% of your average weekly wage. In most instances, partial disability payments are even less than ½ of your pre-injury earnings. Needless to say, it is impossible for many people to survive on partial Workers’ Compensation payments.
In certain cases, it is possible to supplement your partial disability payments from Workers’ Compensation with unemployment benefits. If you are receiving partial disability benefits, we strongly urge you to contact unemployment and apply for supplemental benefits.
There is no guarantee that you will receive unemployment benefits as there are work requirements and filing deadlines in place at unemployment.
