Section 300.34 of the NYCRR has given the New York State Workers’ Compensation Board the right to schedule an expedited hearing process, also known as “rocket docket.” This process was created to streamline the litigation process with the goal of faster resolution of those specific cases chosen for the “rocket docket.”
Our office has handled many “expedited cases.” The cases are being moved much more quickly than non-rocket docket calendars; however, the burdens placed on both sides can sometimes be unreasonable. The jury is still out on the equity of the rocket docket system as it sometimes compromises the parties’ rights and opportunity to fully and properly present a legal case as the 90-day timeframe is not always practical. On the other hand, quicker resolution of claims is beneficial to all parties involved. Over the next several years, we will have a better idea of the effectiveness of the program.
