As required by New York State Workers’ Compensation “Reform” statute, the maximum rate of payment for New York State Workers’ Compensation claimants injured on or after July 1, 2010 will increase from $600.00 per week to $739.83 per week.
The maximum weekly benefit rate will now be set as 2/3 of the New York State average weekly wage for the last calendar year as calculated by the New York State Department of Department of Labor.
The Department of Labor has determined that for the calendar year 2009 the average weekly wage was $1,109.75 per week. 2/3 of that amount will now be the maximum weekly benefit or $739.83 per week.
The rate increase will only affect those injured after July 1, 2010 having actual average weekly wages in excess of $1,109.75 per week.
