As in any judicial system, the Judge or decision maker wields supreme power over resolution of your case. Different Judges have different personalities, life experiences, and political persuasions which clearly impact their decisions. There is no doubt that even reasonable Judges could come to completely different conclusions when reviewing the exact same case evidence.
Recently, a class action lawsuit was filed in Federal District Court in Brooklyn, NY alleging that more than half of the Social Security Judges in Queens have demonstrated a prejudice in their rulings resulting in unfair denials to hundreds of Social Security claimants.
The Judges in question have rejected over 60% of the cases that they have heard in the last 6 or 7 months.
Whether or not the class action lawsuit will succeed is unknown. However, the harsh reality is that part of the result in your claim depends on the luck of the draw: which Judge will you get to hear your case?
